City of Miami
City of Miami Department of Building / South Florida Water Management District (SFWMD)
CityMS4 Phase IVerified 2026-03
Local Permit / Authorization
- Permit Required
- Yes
- Permit Name
- Building Permit with Stormwater Management / Environmental Resource Permit (ERP) Compliance
- Submit To
- City of Miami Department of Building / South Florida Water Management District (SFWMD)
- Lead Time
- City building permit review 2–4 weeks; SFWMD ERP review 4–8 weeks for individual permits
- Application Method
- City permits online via iBuild Miami; SFWMD ERP via ePermitting portal (my.sfwmd.gov)
- Fee
- City building permit fees per project value; SFWMD ERP application fee $500–$8,000+ depending on project size
Water Quality Standards
- Impervious Cover Limit
- No citywide cap; stormwater treatment required for all new development per SFWMD ERP and City Code Chapter 60
- On-Site Treatment Required
- Yes
- Detention Required
- Yes
- Detention Standard
- Pre-development vs. post-development discharge rate matching for 25-year/72-hour storm; water quality treatment volume = 1 inch over the project area or 2.5× the percentage of impervious area (whichever greater) per SFWMD rules
- Turbidity Standard
- Must comply with FDEP Generic Permit and Florida surface water quality standards (29 NTU above background in Class III waters)
Local SWPPP / Drainage Plan
- Local Plan Required
- Yes
- Plan Name
- Erosion and Sediment Control Plan required with building/grading permit; Stormwater Management Plan required per SFWMD ERP
- PE Stamp Required
- Yes
Stormwater management plans submitted to SFWMD must be prepared and sealed by a Florida-registered PE. The city's flat terrain and high water table significantly constrain BMP selection.
Local Inspection Requirements
- Requirements
- City building inspections at construction milestones. SFWMD conducts ERP compliance inspections. Post-construction stormwater systems require long-term operation and maintenance per recorded covenant.
- Inspector Qualification
- No state-specific inspector certification required; CPESC/CESSWI recognized; PE qualifies for SWPPP preparation
Special Overlay Zones
Biscayne Bay / Coastal Zone
Trigger: Properties draining to Biscayne Bay or within coastal high hazard area
Restriction: Enhanced water quality treatment for Bay discharge; Biscayne Bay is an Outstanding Florida Water (OFW) — stricter discharge standards; no degradation of water quality
Flood Zone AE / VE
Trigger: Properties within FEMA Special Flood Hazard Area (most of Miami is in a flood zone)
Restriction: Base flood elevation + freeboard required; compensatory storage; no fill in floodway; Miami-Dade County floodplain regulations may exceed FEMA minimums
Wellfield Protection Area
Trigger: Properties within designated wellfield protection zones
Restriction: Restricted land uses; no hazardous materials storage; enhanced stormwater treatment to protect drinking water supply; infiltration BMPs restricted

Jurisdiction Notes
Miami's extremely flat terrain (avg. elevation ~6 ft), high water table (often < 3 ft below grade), and porous limestone substrate make traditional infiltration and detention challenging. Most stormwater systems rely on exfiltration trenches and wet detention ponds. Biscayne Bay OFW status imposes enhanced water quality requirements. All development effectively requires dual permitting: City building permit + SFWMD ERP.
Remember: These local requirements are in addition to the FDEP state construction permit. Both must be satisfied before breaking ground.
